  • When a W-9 comes in and it has a persons name on line 1  with their social security number on it but the W-9 has a business name on line 2 and the invoice we recieve is for the buisness name, who should we make the check out to? Who should we report to?
  • As the filling deadline moves to Jan 31 for Misc box 7 payments, is it consider the timely filling if we send out electronic file by Jan 31 and send out replacement file after Jan 31? If yes, what is the dead line for sending out replacement file? Would it be the same as filing the extension like before? 
  • Is a non profit organization 1099 reportable?  They do not state if they are a 501C or what they are,  they just state on the W-9  Non-Profit. 
  • If a title company is not incorporated, do we report payments made directly to the title company for things such as: Property reports or title searches?
  • For 1042 filing,  should the dollars reported include sales tax in the total, if applicable?
  • How long are we required to keep 1099's?  We are an insurance company that process roughly 3,000 Form 1099's per year.  Currently we have them as far back as 1997.
  • Which AP payments are exempt from FATCA 30% withholding?
  • If a foreign vendor provides online web training but not physically being here in the U.S., is 1042-S reporting still required?
  • If a foreign vendor submits a completed Form W8, does it mean that they’re exempt from the 30% withholding?  If not, how do we decide whether the 30% withholding requirement should apply to them or not?
  • What happens with the 30% withheld in foreign reporting?  Does the foreign company have any recourse to collect it?  If the foreign company has a US branch  that is set up as a corporation with a US Tax ID, does this get applied against the taxes due from the US branch?
  • We currently issue a 1099-Misc when commissions are earned.  The commissions may not necessarily be paid out to the agent yet but have been earned by the agent.  Is this best practice?
  • Our Board of Director members have been treated and reported as employees.  Is it customary to treat Board of Director members as "employees" instead of "independent contractors"?  If we were to treat and report them as independent contractors, then at year end they would receive 1099-MISC form instead of a W-2 form?
  • When a vendor marks a W9 as an LLC and then puts in the D for Disregarded Entity, are they exempt from 1099 reporting?
