I found on page 2 of the instructions of the W-9 it states under the section "What is backup withholding?" that real estate transactions are not subject to backup withholding. With that in mind, what do I report for a payee providing less than their full TIN?

What is the obligation to print and mail a 1099 when the last known address on the account is incorrect, the account is closed (was an insurance/annuity account), and/or the recipient is known to be deceased? The question isn't about what to keep when the 1099 is returned as undeliverable by the PO, but are we required to mail the 1099 under the above stated circumstances?

Could you tell me what the Statute of Limitation is on corrections for 1099R's? Ie. if we found a problem with one 1099R in our thousands that we file and find that it has been reported wrong for years... how far back do we have to correct?

We are working on creating a database for our W-9's. We are scanning each paper form and attaching it in pdf format.
- Are we required to keep paper copies if we are able to print them from the pdf format?
- How long are we required to keep paper copies?
- If we have older versions of the form, are we required to contact the vendor and replace with the most current form?
Proposed Penalty Notice and Third Party Claims Administrator
This question is in reference to a Proposed Penalty Notice 972CG that we received last month. Our company uses a third-party administrator to pay medical and healthcare claims. On 12/31/08, we terminated our contract with this TPA. The TPA filed 1099-MISCs on our company's behalf in 2009 (using our company name and EIN) for medical and healthcare payments that the TPA made in 2008. This spring our company received a CP-2100 identifying 441 name/TIN mismatches for the TCC used by the third-party administrator for those 2008 1099s. We sent the notice and the file to the TPA along with a letter outlining what they must do to demonstrate that they acted in a responsible manner when processing the B notices. When we received the Proposed Penalty Notice 972CG last month, we sent that to the TPA along with the file we got from the IRS. We asked for a written response demonstrating how they complied with the B notice processing in a responsible manner so that we could prepare a penalty waiver request. Today I received their response that they took no action on the spring B notices because of the termination of the contract on 12/31/08. So my question is: Is there any argument we can use to request a penalty waiver in this case?

W-2 Reporting Question and Record Storage
W-2 reporting questions: 1) If we deduct retirement plan contributions and check box 13, are we required to report the total amount in box 12? 2) The IRS gives instructions that the employer is to keep undeliverable W-2s that the employer tried to deliver but could not for four years. What is the IRS definition of “tried to but could not deliver”? Does that mean sending to the last known address on record or does the IRS require employers to do research in an attempt to locate the individual?
