I Have Not Received A B-Notice Report: Should I Contact the IRS?

Question

We have not received the B-Notice report yet. We called the IRS on October 5 and were told at that time the B-Notice would be mailed October 24. Please advise as to what our next step is. If we didn't have any errors would we still receive some notification?

Answer

The CP2100 or CP2100A Notice includes a listing(s) of the information returns you filed that had missing, incorrect, and/or not currently issued TIN(s).You will receive no notice letting you know that the IRS did not find any missing, incorrect, and/or not currently issued TIN(s). But there is no need to contact the IRS and we recommend that you don't.

What Lines on the Form W-9 Do We Use for DBA name's?

Question

We have a very large vendor database where the DBA's were placed on the first line and the individuals' name on the second line ---these were our instructions in prior years. They have not kicked out for B-Notice purposes ---should we be concerned about this and work on changing these or since we have not had any problems - are they OK as is?

Questions about B-Notice's and LLC's/DBA's

Question

We have received some B-Notice items for 2011.

On 1099s for partnerships and LLC's - should the legal name go on the first line and the dba on the second line?  If this is incorrect, would this cause the 1099's to kick out on B-Notice statements from the IRS?

Also, if the address is not on one line ---would that cause the 1099 to kick out?  One of the vendors kicking out has the Suite # on the second line of the address.

Do we need two lines for the Partnerships and LLC's - can we only have one name on one line?

We believe we have the ID numbers correct so we are trying to figure out what would cause these vendros to kick back.

Easement Purchase and Payee Not Providing Full TIN

Question

I found on page 2 of the instructions of the W-9 it states under the section "What is backup withholding?" that real estate transactions are not subject to backup withholding.  With that in mind, what do I report for a payee providing less than their full TIN?

Easement Purchase and Payee Refuses to Provide Full TIN: What do we do?

Question

We are purchasing an Easement from an individual who is refusing to provide more than the last 4 digits of their social security number.  Since this is a real estate transaction, all amounts are reportable.   I am not quite sure what to do in this situation.

1.  Withhold a percentage of the payment?

2.  Obtain an explanation in writing?

3.  Accept the incomplete number and request another W-9 when a B Notice is sent?

Combination of the above?

Completed 2nd B-Notice Process But Still No Response: Do I Need a Letter147C to Be in Compliance?

Question

I have a vendor who appeared on my 2008 B notice list and my 2009 B Notice list.  I sent the first notice letter and resolved the issue in November 2009 by saying the our files and IRS agree.  Resolved 2009 B notice letter by discovering we had the EIN wrong.  Updated EIN and then sent all EINS via bulk submission and received a match from the IRS on October 2010.  I did send a second B notice letter on November 1, 2010.  Never received a response back.  Question is now there is a request to make a new payment to the vendor.  I have updated the EIN, IRS tin matching, but do not have a letter147C.  Do I need one to be in compliance?

Do we include rent paid for storage as reportable on . . .

Question

Do we include rent paid for storage as reportable on the Form 1099-MISC?

Answer

Although the regulations are not perfectly clear on the interpretation of storage payments, we believe you should report rental payments for storage. Both the Form 1099-MISC instructions and section 1.6041-3(d) indicate that storage itself is not reportable; however, it is clear that rental for space is reportable.
